Public Consultation: Methodology for Assessment of Significant Market Power (SMP)

Today the Utilities Regulation and Competition Authority (URCA) published a consultation paper entitled Methodology for Assessment of Significant Market Power (SMP) Under Section 39(2) of The Communications Act, 2009. This document reviews and seeks comments from stakeholders and interested parties. It proposes, inter alia, an approach to market reviews for the assessment of SMP and for addressing the transitional provision of SMP licensees currently existing under s.116 of the Communications Act, 2009.

Interested parties may download copies of the consultation paper from the Publication section of URCA’s website at www.urcabahamas.bs. Responses to the consultation paper should be submitted to URCA by 5:00 p.m. on 29 June 2011. URCA will subsequently review responses received to the consultation paper and publish a Statement of Results on the consultation. The Statement of Results will identify the next steps to be taken by URCA in relation to the review of relevant markets and the assessment of SMP by Licensees operating in the Electronic Communications Sector (ECS) in The Commonwealth of the Bahamas.
