The Utilities Regulation and Competition Authority (“URCA”) hereby issues this notice in exercise of its power under section 8(1)(e) of the Communications Act, 2009 (“Comms Act” ).
TAKE NOTICE that on 26 October, 2017 URCA issued a Final Determination, having determined that FutureNet Consulting & Professional Services Ltd. (“the Licensee”) breached Condition 1.11 of its Class Operating Licence Requiring Registration (“COLRR”) by having failed and/or refused to pay as notified by URCA in accordance with the Comms Act;
AND TAKE NOTICE that on 26 October, 2017 URCA issued an Order consequential to the said breach ordering that the Licensee pay in full the outstanding annual URCA Fee and interest within fourteen (14) calendar days of service of the Order, failing which the Licensee’s COLRR would be revoked pursuant to section 27(1)(c) of the Comms Act;
AND TAKE NOTICE that the Licensee has failed and/or refused to comply with the said Order;
NOW TAKE NOTICE that in exercise of its power under section 27(1)(c) of the Comms Act, URCA hereby revokes the Licence issued to the Licensee;
AND TAKE FURTHER NOTICE that under section 16 of the Comms Act, it is an offence for any person to establish, maintain and operate a network or provide a carriage service, including the use of radio spectrum, punishable under section 107 of the Comms Act to a fine not exceeding five hundred thousand dollars ($500,000.00) upon summary conviction.
